As I have been saying all along, #fiveeyes vandalises all protocols for intercepts; it is not yet demonstrated, however, that #china does the same. If it does, why not show us proof? Sure, it might be tempted to in the future (Trojan horse approach).

Bill "Telecommunications and Other Legislation Amendment (Assistance and Access) Bill 2018" is currently being reviewed by the Parliamentary Joint Committee on Intelligence and Security (PJCIS).

This bill would do the following:
- harm the digital security of our devices, software, networks and internet infrastructure;
- put the information security that individuals and organisations need at risk; and
- further diminish trust in Australia as a country that upholds digital security and human rights.

To make things worse, this bill lacks the accountability and transparency mechanisms that are needed to ensure that it doesn't get abused, notably lack of judicial oversight and extensive secrecy clauses.

In September, over 15000 submissions were written to the Department of Home Affairs, including from human rights advocates, technology companies and security experts. The Australian Government's draft bill "Assistance and Access Bill 2018" has been a serious concern for tech companies, digital rights advocates and individuals in Australia and around the world, a bill for which feedback to their "consultation" concluded 2018.09.10(Mon).

Despite this draft bill being written over at least several months but possibly as long as 2 years, Australians and the digital community were given only weeks to provide feedback. Although it appears that some prior consultation with tech companies was done, it may be limited to the biggest few, with smaller tech companies and digital rights advocates most likely excluded from the process. Electronic Frontiers Australia asked the government to see the legislation for 2 years[1].

Australia's Assistance and Access Bill 2018


In mid-August, the Australian Government's Department of Home Affairs has released a draft of a bill in regard to digital communications and devices "Telecommunications and Other Legislation Amendment (Assistance and Access) Bill 2018" [1], and is asking for feedback. Submissions are due 2018.09.10(Mon), and I encourage concerned people to submit their feedback to the consultation.

The content of this bill is quite concerning, especially when looking at the detail[2]. It would allow the government to issue a "notice", with no independent oversight and on "reasonable and proportionate" grounds[3], to compel communications providers (with its definition being broad) into implementing weaknesses such as backdoors into encrypted systems and concealing the weakness and actions taken, and would make it an offence to disclose information about requests and notices.

This would mean a weaker digital security ecosystem, further erosion of human rights (eg: privacy) and freedoms (eg: of expression), and lack of accountability... Show more...
