Ruling by EU’s highest court is second landmark judgment against Poland’s judicial policy in recent months

The European Union’s highest court has ruled that Poland broke the law when it sought to lower the retirement age for judges, in a further defeat for the country’s nationalist government.

The European court of justice (ECJ) found that a 2017 policy to lower the retirement age for ordinary judges in Poland was unlawful because it gave too much power to the executive, and ruled that a decision to compel female judges to retire five years earlier than men broke EU equality law.

It was when the guards began burning piles of bodies in the open because the crematorium could not keep up with the task that Marek Dunin-Wąsowicz realised he was being held in a camp whose purpose was not just to “concentrate”, but systematically to murder thousands of people.

In the autumn of 1944, the 17-year-old Pole saw trainloads of Jews, most of them from Hungary, being taken straight to the gas chambers at Stutthof. Others were gassed inside an adapted railway carriage, set on tracks to trick prisoners into believing that they were being transported to another destination.

Poland’s ruling nationalist Law and Justice party won Sunday’s parliamentary election, doing better than when it swept to power four years ago, accordingly to nearly complete results.

According to official results from 91% of constituencies published by the electoral committee on Monday, Law and Justice has taken 44.6% of vote, ahead of the country’s biggest opposition grouping, the liberal centre-right Civic Coalition, on 26.7%, and the leftist alliance the Left on 12.3%.
